Terms of Service

By accessing or using Lumaco, you represent that you are at least 16 years old and have the legal capacity to enter into a binding agreement. If you are using Lumaco on behalf of a business, you represent that you have authority to bind that business to these Terms.

We may update these Terms from time to time. Material changes will be communicated by email or in-app notice at least 14 days before they take effect. Continued use after changes take effect constitutes acceptance.

Lumaco is an AI-powered marketing platform that helps small businesses create marketing campaigns, social content strategies, reel scripts, posting schedules, and growth plans. The service is provided on a subscription basis and may include access to third-party AI models and analytics integrations.

We reserve the right to modify, suspend, or discontinue any part of the service at any time, with reasonable notice where possible. We are not liable for any modification, suspension, or discontinuation.

You must create an account to use Lumaco. You agree to:

• ✦Provide accurate, current, and complete information during registration
• ✦Keep your account credentials secure and not share them with others
• ✦Notify us immediately at support@lumaco.ai if you suspect unauthorized access
• ✦Accept responsibility for all activity that occurs under your account

We reserve the right to suspend or terminate accounts that violate these Terms.

Plans

Lumaco offers the following subscription plans, billed monthly:

• ✦Creator — $49/month
• ✦Growth — $149/month
• ✦Pro — $349/month

Free trial

New subscribers receive a 7-day free trial. You will not be charged during the trial period. After 7 days, your chosen plan will automatically begin and your payment method will be billed.

Billing

Subscriptions renew automatically on a monthly basis. Payments are processed securely by Stripe. By providing a payment method, you authorize us to charge the applicable subscription fee each billing cycle. All prices are in USD and do not include applicable taxes.

Plan changes

You may upgrade or downgrade your plan at any time from your account settings. Upgrades take effect immediately and are prorated. Downgrades take effect at the start of the next billing cycle.

Cancellation

You may cancel your subscription at any time from the billing section of your dashboard. Cancellation takes effect at the end of your current billing period. You retain full access to paid features until that date.

Refunds

We offer refunds at our discretion. If you experience a technical issue preventing you from using the service, contact support@lumaco.ai within 7 days. We do not offer refunds for partial months or for failure to cancel before a renewal date. If you believe you were charged in error, contact us within 30 days.

You agree not to use Lumaco to:

• ✦Generate, publish, or distribute content that is illegal, defamatory, harassing, or fraudulent
• ✦Impersonate any person or entity or misrepresent your affiliation
• ✦Circumvent, disable, or interfere with security features or access controls
• ✦Scrape, crawl, or extract platform data by automated means without permission
• ✦Use the platform to send unsolicited communications (spam)
• ✦Upload malicious code, viruses, or any software intended to damage systems
• ✦Resell or sublicense access to the platform without written permission
• ✦Attempt to reverse-engineer, decompile, or derive the source code of Lumaco

We reserve the right to suspend accounts without notice if we detect a violation of this section.

Lumaco uses large language models (including the Anthropic Claude API) to generate marketing content, campaign strategies, scripts, and other outputs. You acknowledge that:

• ✦AI-generated outputs are suggestions and starting points, not professional legal, financial, or marketing advice
• ✦You are solely responsible for reviewing, editing, and approving all content before publishing or using it
• ✦AI models can produce inaccurate, incomplete, or inappropriate outputs — always review before use
• ✦You are responsible for ensuring your use of AI-generated content complies with applicable laws and platform policies (including advertising standards and copyright requirements)
• ✦We do not guarantee that generated content will achieve any specific marketing result

Your content

You retain ownership of all business information, brand assets, and inputs you provide to Lumaco. You also own the campaign outputs and content generated for your account. By using the platform, you grant us a limited, non-exclusive license to process your inputs solely to deliver the service to you.

Our platform

Lumaco, including its software, design, trademarks, and underlying technology, is owned by us and protected by intellectual property law. These Terms do not grant you any ownership rights in the platform itself. You may not copy, modify, or distribute any part of Lumaco without written permission.

Feedback

If you submit feedback or suggestions, you grant us the right to use that feedback without compensation or attribution.

Lumaco is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the service will be uninterrupted, error-free, or free of harmful components.

To the maximum extent permitted by law, Lumaco and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the service, including but not limited to loss of revenue, loss of data, or loss of business opportunity.

Our total liability to you for any claim arising under these Terms shall not exceed the amount you paid us in the 12 months preceding the claim.

You agree to indemnify, defend, and hold harmless Lumaco and its affiliates, officers, and employees from any claims, damages, losses, and expenses (including legal fees) arising out of: (a) your use of the service; (b) your violation of these Terms; (c) any content you submit or publish using the platform; or (d) your violation of any third-party rights.

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any dispute arising from these Terms or your use of Lumaco shall be resolved through binding arbitration conducted in English, except that either party may seek injunctive relief in a court of competent jurisdiction for intellectual property matters.
